One man is dead and two others are prisoners in the Fayette county jail as a result of a mysterious shooting affray that occurred early Sunday morning,May 28,1922 at Arnold City. The dead man is John Tomalski, aged 42 years, while the prisoners in jail at Uniontown are Robert Smock and John Carp. According to information reaching this office, all three were members of a party visiting at a house at Arnold City, where moonshine was being sold. It is alleged Carp and Smock had an altercation and friends of Smock claim that Carp had secured a shot gun from George Downs. In the yard at the home, the squabble was continued and two shots were fired and Tomalski, an innocent bystander, fell mortally wounded. A physician was called and the man was ordered to be removed to the Charleroi-Monessen hospital,but he died enroute to the institution. He is survived by his wife and eight children. Immediately following the shooting Smock hired a taxi and drove to Uniontown,where he gave himself up,stating that a man had been shot at Arnold City and he expected that he would get into trouble. Constable Bierer assisted by W.L.Bierer,investigated and arrested Carp,who was later turned over to County Detective Russell and lodged in the Fayette county jail. It is claimed that Tomalski made a dying statement in which he accused Smock of firing the fatal shot. Stanley Rygel,who claimed he was sitting on a door step nearby heard the shot and on reaching the scene,was told by Tomalski that Smock had shot him.
